Drunken Driving/Abetment

As per the Motor Vehicles Act, 1988, the legal blood alcohol limit for drivers in India is 30mg of alcohol per 100ml of blood. If a driver is found to exceed this limit, he or she can be penalized with a fine of up to Rs. 10,000 and/or imprisonment of up to six months for the first offense. For repeat offenses, the penalty can be imprisonment for up to two years and/or a fine of up to Rs. 15,000.

Abetment to drunken driving is also considered a serious offense. If a person encourages or aids another person to drive while under the influence of alcohol or drugs, they can be charged with abetment to drunken driving. This offense is punishable under Section 109 of the IPC, which provides for imprisonment for up to three years, a fine, or both.
